As part of a client solution, Inside Niche utilizes and refers third-party services and products to perform services. These third party solutions may include but are not limited to: email marketing services, domain and website hosting providers, mobile marketing and text message services, WordPress.org, WordPress themes and plugins, eCommerce platforms, social media platforms (i.e. Facebook, LinkedIn, Twitter, etc.) and related tools and plugins, Google web development and analytics, ftp sites, search engine optimization tools, etc. (the “Service”). You understand and agree that the Service is provided “AS-IS” and that Inside Niche assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any contents or settings. Inside Niche has the right to hire third-party contractors as needed to complete a project. From time to time Inside Niche will bundle services as part of a packaged solution. You are responsible for the costs of your own domain registration names and website hosting for your website(s), as well as any third-party costs not covered in the product or service purchased from us. If InsideNiche is terminated as a service provider, any third-party plugin services used by us will be cancelled at the time of termination. You are responsible for contacting the third-party service provider to transfer applicable services to you, if you so desire. If you’ve selected one of our packaged solutions, you may at any time request a list of third-party providers used with your account.

Inside Niche takes privacy issues and irresponsible marketing seriously (review our Privacy Policy). Immediate grounds for termination include the following:
- Misuse of personal information and/or SPAM. If at any time Inside Niche suspects or confirms the misuse of personal data (i.e. email addresses, phone numbers, addresses and other personal information), or in the form of Spam (unwanted and unsolicited email, text, or other information). - Advertising to Children, with special consideration marketing to Children under 13. Inside Niche follows the Consumer Best Practices Guidelines regarding advertising and marketing to children. Any conduct in violation of any applicable laws and industry standards in the compliance of the FCC’s Children’s Television Act and Children’s Online Privacy Protection Act (COPPA), FTC advertising regulations, Children’s Advertising Review Unit (CARU).
Upon termination, these Terms of Use shall still apply.
Additional Legal Matters
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Washington, USA, as they apply to agreements made and solely performed therein. If a dispute arises under this agreement we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Clark County, Washington. If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration subject to the jurisdiction of the State Courts of Washington and/or the Federal Courts of the United States. These Terms of Use incorporate by reference any notices contained on this website and constitute the entire agreement with respect to your access to and use of this website. Any provision of these Terms of Use which is determined by a court of competent jurisdiction to be unenforceable in any jurisdiction shall be severable from these Terms of Use in that jurisdiction without in any way invalidating the remaining provisions of these Terms of Use.
